Terms of use
1. About Waymark and these terms
Waymark is a service for recording, collecting and sharing walks, hikes, rides and the routes, places and photos that go with them. It is run by [name of the operator], [address] (“we”). These terms apply to every use of Waymark: the website, the app and the API. By creating an account you accept them, together with the privacy statement.
2. Who can use Waymark
You must be 16 years or older. One account per person; an account is personal and may not be handed over. For now new accounts are created by the admin, through an invite link, or after the admin approves a request. We may refuse a request without giving a reason.
3. Your account
Keep your password and any API tokens to yourself. You are responsible for what happens with your account. Tell the admin straight away if you think someone else has access to it. The details you give (username, email address) must be correct and must not impersonate someone else.
4. Your content
Everything you upload or record — activities, tracks, routes, places, photos, texts — stays yours. You give us the permission needed to store, process and show it in order to provide Waymark to you, and to show it to the people you choose to share it with. That permission ends when you delete the content or your account, apart from backups that expire on their own schedule (see the privacy statement).
New content is visible only to you unless you choose otherwise. You only upload content you have the right to upload, and you do not upload personal data of others (for example photos in which people can be recognised) without their permission.
5. What is not allowed
- anything unlawful, including infringing someone else's rights;
- harassment, threats, hateful or sexual content involving others, spam or advertising;
- malware, attempts to get into other accounts, or to bypass security, rate limits or quotas;
- automated collection of data from Waymark beyond what the API offers you for your own data;
- using imports (files or web addresses) to store material that is not about your own outdoor activities.
6. Strava and other connected services
You can connect your Strava account to import activities. That connection is also governed by Strava's own terms. Under Strava's API agreement, data imported from Strava is shown to you only, never to other Waymark users. You can disconnect Strava at any time.
7. Admin, moderation and suspension
The admin manages Waymark and can see all data where that is needed to run it, to help you, or to handle abuse. Every such look is recorded in an internal audit log. We may hide content, suspend or delete an account that breaks these terms or puts others at risk. Where possible we tell you why.
8. Availability and liability
Waymark is a small service run on a best-effort basis. We do our best to keep it available and your data safe, but we cannot guarantee that the service is free of interruptions or errors, or that data is never lost — keep your own copies of what matters to you (you can download all your data in your account settings). To the extent Dutch law allows, we are not liable for indirect damage or for loss of data; this does not limit liability for intent or gross negligence, nor any rights you have as a consumer.
9. Ending your account
You can delete your account at any time in your account settings. Deletion takes effect after a grace period of 30 days; signing in during that period cancels it. After that your account, content and files are removed. Comments you placed on someone else's item stay, without your name. We may end the service as a whole; we will announce that in advance and give you the chance to download your data.
10. Changes to these terms
When these terms or the privacy statement change in substance, the version number goes up and we ask you to accept the new version the next time you use Waymark.
11. Applicable law
Dutch law applies. Disputes go to the competent court in [district], unless the law gives you as a consumer the right to go to the court where you live. Questions or complaints: [contact email address].
